Sample Cases, Opinions and Rulings
In this section, I have put up a number of actual case rulings for D.A.A.D. Hearings that I have attended and won have over the last several years. It's rather hard to keep posting these, so they will be done in batches every year or so. Thus far, in 2010, I have won every case I've handled. I still have a ton of 2009 cases to put up, but as I said, I'll get to that.
The majority of these Opinions represent the initial restoration of a license, but some show what happens after a person has done their year on a restricted license and then files for (and in all of my cases) wins unrestricted driving privileges. Most of the Opinions are fairly recent, because when I came up with this idea of putting up these cases on the website, many of those files from years past had already been closed, and put into storage. Obviously, all personally identifying information has been excised, and I have also taken the liberty to excise anything that could generally even hint at the identity of my client.
As part of each order where a license has been granted, there are a couple of pages of instructions. Rather than repeat these same pages in every case, I have put them up separately, at the end of this section, under the titles “Standard Requirements Once Granted Restricted License,” and “Ignition Interlock Certified Vendors.”
I hope the reader will at least take the time to read through enough of theses Opinions to develop a sense of what matters to the Hearing Officers who conduct these Hearings and make these rulings. Many of the Opinions are very short, and merely show that a license has been granted. There are a number, however, which get into some detail about the evidence submitted before the Hearing (i.e. Substance Abuse Evaluation and Letters of Support) as well as the Petitioner’s testimony.
